TERMS AND CONDITIONS OF SALE (CGV)

PREAMBLE

The present general conditions of sale govern the contractual relations between :
Babusia L'âme slave, represented by Virginie Hoffmann, located at 51 rue du Général Devink, 59270 Godewaersvelde (SIRET 78887092100038), hereinafter referred to as "the Seller" ;
And any individual or legal entity, hereinafter referred to as "the Buyer" or "the Customer", placing an order on https://www.babusia.com, hereinafter referred to as "the Website".

These general terms and conditions of sale apply to all orders placed by the Buyer on the http://www.babusia.com website.



Article 1 - Scope of application

By placing an order on the site, you declare that you are at least 18 years old and have the necessary legal capacity. Any order implies full acceptance of these terms and conditions of sale, as well as the prices and descriptions of the products offered.

Babusia - L'âme slave reserves the right to modify all or part of these terms and conditions of sale without prior notice.

Article 2 - Products sold on the Website

The products governed by these terms and conditions are those which appear on the Seller's Website and are indicated as sold and shipped by Babusia - L'âme slave. They are offered while stocks last.

Product descriptions are provided as accurately as possible. However, the Seller cannot be held responsible for any errors or omissions. Product photographs are non-contractual and are provided for information only.


Article 3 - Prices

Prices are indicated in euros, inclusive of all taxes. They do not include delivery charges, which are invoiced in addition and indicated before final validation of the order.

The Buyer is informed that validation of the order requires immediate payment via the Website.

The Vendor reserves the right to modify its prices at any time, but undertakes to apply the prices in force at the time of the order, subject to availability.

Article 4 - Delivery charges

The Vendor delivers in France and abroad.
Shipping costs include preparation, packaging and postage.

- France and international: Jewellery under 3 cm is sent by recorded delivery, insured by the French Post Office. A tracking number will be sent to you once the purchase has been confirmed.
- Jewelry over 3 cm (cuffs, etc.): These items are sent by Colissimo, a service offering protection and delivery more suited to bulky items. Please note that Colissimo shipping costs may be higher for international deliveries.

Article 5 - Delivery times

Delivery times begin on the date payment for the order is received in the Vendor's bank account.

For one-off creations, delivery takes 1 to 3 working days from the day following receipt of payment. Items made to order require additional time.
Shipments are made from Tuesday to Saturday. There are no shipments on Mondays due to the closure of postal services.

Products ordered will be sent to the address you provide during the ordering process.
Babusia declines all responsibility in the event of late delivery due to an incorrect or incomplete address provided by the customer, the absence of the recipient at the time of delivery or failure to collect the parcel within the time limit set by the carrier.

In the event of an order being returned for these reasons, the cost of reshipment will be borne by the Buyer.

Article 6 - Customs duties
If you reside outside the European Economic Area (EEA), customs duties and taxes may apply upon receipt of your parcel. The prices indicated do not include any customs duties, taxes, fees or other charges relating to the import of goods. These costs are the responsibility of the Buyer or recipient.

Babusia - L'âme slave is not obliged to check or inform the Buyer of these costs. The Buyer is advised to check with the competent authorities of his country or territory before placing an order.

Article 7 - The order

The Buyer may add the products he/she wishes to order to his/her basket by clicking on the "Add to basket" button. To validate the order, the Buyer must click on "Checkout".

Any order placed on the Website implies acceptance of the prices and descriptions of the products contained in the basket.
In the event of a problem (non-payment, incorrect address, or any other problem linked to the Buyer's account), the Vendor reserves the right to suspend the order until the problem has been resolved.

An order confirmation e-mail will be sent automatically to the address provided by the Buyer.

Any anomaly relating to the order (missing item, damaged parcel, defective item) must be reported within 2 days of delivery. After this period, no request for exchange or refund will be accepted.

Article 8 - Payment methods

During the ordering process, you will be offered the following payment methods to pay for your purchases:

- via Stripe (for CB, Visa, Paypal...)
- in cash for pick-up in Godewaersvelde.
Whichever payment method you choose, payment will only be considered final once the funds have been received in full.
The invoice will be sent in electronic format for orders delivered in France, and in paper format for international deliveries.

The Vendor reserves the right to suspend all order processing and delivery in the event of refusal to authorize payment by accredited bodies or in the event of non-payment.
The Vendor also reserves the right to refuse delivery or to honor an order from a Buyer who has a payment dispute or who has not paid for a previous order.

Article 9 - Delivery terms

Delivery of products ordered will only take place once payment has been confirmed by the Seller's bank. Delivery times begin to run from this confirmation.

Products are delivered to the address indicated by the Buyer on the order form. Delivery is made by Lettre Suivie or colissimo, directly to your letterbox.

Article 10 - Right of withdrawal

In accordance with article L.121-20 of the French Consumer Code, our consumer customers have a period of fourteen (14) clear days from receipt of the goods to exercise their right of withdrawal, without having to give any reason or pay any penalties, with the exception of the cost of returning the goods. However, no right of withdrawal applies to products made to customer specifications or clearly personalized.

For all returns, please contact us by e-mail at contact@babusia.com. Once we have received your request, we will inform you of the procedure to follow, in particular how to return the goods, at your expense, to the following address:

Items must be returned in their original packaging, in perfect condition, allowing them to be sold as new. To facilitate the processing of your return, we recommend that you enclose the delivery note with the returned items.

If you exercise your right of withdrawal within the specified period, the amount of the products returned will be reimbursed to you in full by the means of payment used for the order, as soon as possible, and at the latest within thirty (30) days of the date on which the right of withdrawal was exercised.


Article 11 - Reservation of ownership

The Vendor retains ownership of the products until the price has been paid in full and deposited at the post office. The risks relating to the delivery of the products ordered are transferred to the Buyer once the delivery has been made.


Article 12 - Intellectual property

"Babusia - L'âme slave" is a registered trademark with the INPI. All models, concepts, texts and photographs are the exclusive property of the designer. Each piece, in particular the handcrafted beaded creations, is the fruit of meticulous and unique work, protected by both copyright and trademark law.

Every "Babusia - The Slavic Soul" design, including the beaded creations, is also registered with IPOCAMP, guaranteeing international legal protection against unauthorized reproduction or copying.

The reproduction or imitation, even partial, of these designs, whether by other designers or companies, constitutes an act of counterfeiting. Any attempt to appropriate these handcrafted pearl creations by presenting them as original works will be systematically prosecuted, with a claim for damages.

Any use, reproduction or distribution of these elements, without the prior written consent of "Babusia - L'âme slave", is strictly forbidden. This specifically includes the beaded designs, which, although technically within everyone's reach, are protected as original works. Violators are liable to civil and criminal prosecution, including for unauthorized use of photographs.
